Privacy Policy

Jashan Media LLC ("Jashan Media," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect information when you use any of our websites (including jashanmedia.com), our iOS and other mobile applications (each an "App"), and any other products or services that link to or reference this Privacy Policy (collectively, the "Services").

Some Apps or Services may provide an additional, product-specific privacy notice or in-app disclosure. Where they do, that notice supplements this Privacy Policy, and the more specific notice controls for that product. By using the Services, you acknowledge that you have read and understood this Privacy Policy.

1. Information We Collect

We collect only the information reasonably necessary to provide and improve the Services. Many of our Apps can be used without creating an account and without providing any personal information.

a. Information You Provide to Us

Contact and inquiry information: your name, email address, phone number, company name, and the content of your message when you use a contact form, request a quote, or otherwise communicate with us.
Account information: if an App or Service offers accounts, your name, email address, username, and authentication credentials. If you choose Sign in with Apple, we receive the information Apple shares with us, which may be a private relay email address.
User content: text, photos, files, or other content you choose to create, upload, or store using the Services.
Support and feedback: information you provide when you request support, report a problem, rate an App, or send us feedback.
Client project information: information you provide to us in the course of a development, design, or consulting engagement.

b. Information Collected Automatically

Device and usage information: device model, operating system and version, app version, language, time zone, general (non-precise) region, browser type, pages or screens viewed, features used, and the dates and times of access.
Diagnostics: crash logs, performance data, and error reports that help us find and fix problems.
Log data: IP address, referring URLs, and server logs generated when you visit our websites.
Cookies and similar technologies: on our websites, we and our service providers may use cookies, local storage, and similar technologies to operate the site, remember preferences, and understand usage, including Google Analytics cookies as described in Tracking, Analytics, and Advertising. You can control cookies through your browser settings.

c. Information Accessed With Your Permission

Certain App features may ask for permission to access device features or data, such as your camera, photo library, microphone, contacts, calendar, notifications, location, motion sensors, or Apple Health data. We request this access only when needed for the feature you are using, and we explain why in the permission prompt. You can grant, decline, or later revoke any permission in your device settings. Unless an App clearly states otherwise, data accessed through these permissions is processed on your device and is not sent to us.

If an App integrates with Apple HealthKit, health data is used only to provide the App's health-related features, is never used for advertising or data-mining purposes, and is never sold or shared with third parties for those purposes.

d. Purchase Information

In-app purchases and subscriptions in our iOS Apps are processed by Apple. We do not receive or store your full payment card details. Apple may provide us with limited transaction information (such as a transaction identifier, product purchased, date, and subscription status) so that we can deliver and verify your purchase. Payments for client services on our websites may be handled by third-party payment processors subject to their own privacy policies.

e. Information From Third Parties

We may receive information from third-party platforms you choose to connect to our Services (for example, Sign in with Apple or other login providers), and from app stores and analytics providers in aggregated or de-identified form (such as download counts, ratings, and usage trends).

2. How We Use Information

We use the information we collect to:

Provide, operate, maintain, and deliver the Services and their features.
Create and manage accounts and authenticate users.
Process and verify purchases and subscriptions and restore prior purchases.
Respond to inquiries, provide customer support, and communicate with you about the Services, including service-related notices and updates.
Monitor, diagnose, and fix crashes, bugs, and performance issues.
Understand how the Services are used so we can improve them and develop new features and products.
Send marketing communications where you have opted in or where otherwise permitted by law; you can opt out at any time.
Detect, prevent, and address fraud, abuse, security incidents, and violations of our Terms.
Comply with legal obligations and enforce our rights.

3. Legal Bases for Processing (EEA, UK, and Switzerland)

If you are located in the European Economic Area, the United Kingdom, or Switzerland, we process your personal data only where we have a legal basis to do so, including: (a) to perform a contract with you or take steps at your request before entering into one; (b) for our legitimate interests, such as securing and improving the Services, where those interests are not overridden by your rights; (c) with your consent, which you may withdraw at any time; and (d) to comply with legal obligations.

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share information only as described below:

Service providers: with vendors that perform services on our behalf, such as cloud hosting, data storage, form processing, email delivery, analytics, crash reporting, customer support, and payment processing. These providers may use your information only to perform services for us and are required to protect it.
Platform providers: with Apple and other app store or platform operators as necessary to distribute Apps, process purchases, and provide platform features.
At your direction: when you choose to share content or connect a third-party service.
Legal and safety: when we believe in good faith that disclosure is required by law, subpoena, or other legal process, or is necessary to protect the rights, property, or safety of Jashan Media, our users, or others.
Business transfers: in connection with a merger, acquisition, financing, reorganization, or sale of all or part of our business or assets, in which case your information may be transferred subject to this Privacy Policy.
Aggregated or de-identified data: information that cannot reasonably be used to identify you may be shared for any lawful purpose.

5. Tracking, Analytics, and Advertising

Our Apps do not track you across apps and websites owned by other companies unless we first ask for and receive your permission through Apple's App Tracking Transparency framework. If you decline, we will not access your device's advertising identifier (IDFA) or engage in such tracking. You can change your choice at any time in your device's Settings under Privacy & Security > Tracking.

We may use privacy-conscious analytics and crash-reporting tools (for example, Apple's App Analytics or similar third-party SDKs) to understand App performance and usage. Where an App includes third-party advertising, that App will disclose it, and the applicable advertising partner's privacy policy will also apply. The specific data types each App collects are disclosed on that App's App Store privacy label ("App Privacy" section).

Website analytics (Google Analytics): Our website, jashanmedia.com, uses Google Analytics, a web analytics service provided by Google LLC, to understand how visitors use the site so we can improve it. Google Analytics sets cookies in your browser (such as _ga and _ga_<ID>, which typically last up to two years) to distinguish visitors and sessions. It collects information such as the pages you view, how long you stay, the website that referred you, your browser and device type, and your approximate location (city or country) derived from your IP address. Google Analytics 4 does not log or store full IP addresses. We use this information only in aggregated form for site measurement, and we keep it for the period configured in our Google Analytics settings. Google processes this data under its own privacy policy; see How Google uses information from sites that use its services.

Your cookie choice: When you first visit, a cookie banner lets you accept or decline Google Analytics cookies. For visitors in the European Economic Area, the United Kingdom, and Switzerland, Google Analytics does not set cookies unless you click Accept. Elsewhere, analytics cookies are enabled by default and you can decline them at any time. You can change your choice whenever you like using the "Cookie Settings" link in the footer of every page; declining removes existing Google Analytics cookies. We do not use advertising cookies on our website.

You can also opt out of Google Analytics by blocking or deleting cookies in your browser settings, by using a browser or extension that blocks analytics, or by installing the Google Analytics Opt-out Browser Add-on. Opting out does not affect your ability to use the website.

Do Not Track and Global Privacy Control: Because we do not sell or share personal information for cross-context behavioral advertising, there is generally nothing to opt out of; however, we honor Global Privacy Control (GPC) signals where required by law.

6. Data Retention

We retain personal information only for as long as necessary to fulfill the purposes described in this Privacy Policy, including to provide the Services, comply with legal, tax, and accounting obligations, resolve disputes, and enforce our agreements. When information is no longer needed, we delete it or de-identify it. Data stored only on your device or in your personal iCloud account is controlled by you and is removed when you delete the App or that data.

7. Account and Data Deletion

If an App or Service allows you to create an account, you may delete your account and associated personal data at any time from within the App (typically under Settings or Account) or by contacting us as described in the Contact Us section. We will delete or de-identify your data within a reasonable period unless we are required to keep certain information for legal or legitimate business purposes, such as fraud prevention or financial record keeping. Deleting your account does not cancel an active App Store subscription; you can manage or cancel subscriptions in your Apple ID settings.

8. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect your information, including encryption in transit where supported. However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your device and any account credentials secure.

9. Children's Privacy

Our Services are not directed to children under the age of 13 (or a higher minimum age where required by local law, such as 16 in certain jurisdictions), and we do not knowingly collect personal information from children under that age. If we learn that we have collected such information without verifiable parental consent, we will delete it promptly. If you believe a child has provided us with personal information, please contact us. If a specific App is designed for children, it will be accompanied by a separate notice that complies with applicable children's privacy laws and Apple's Kids Category requirements.

10. Your Privacy Rights and Choices

Depending on where you live, you may have some or all of the following rights regarding your personal information:

Access / Know: request confirmation of whether we process your personal information and obtain a copy of it.
Correction: request that we correct inaccurate personal information.
Deletion: request that we delete your personal information.
Portability: receive your personal information in a portable, machine-readable format.
Opt out: opt out of the sale of personal information, sharing for targeted advertising, or certain profiling (we do not engage in these activities).
Restriction and objection: request that we restrict or stop certain processing.
Withdraw consent: withdraw consent at any time where processing is based on consent, without affecting the lawfulness of prior processing.
Non-discrimination: we will not discriminate against you for exercising your privacy rights.

To exercise these rights, contact us. We may need to verify your identity before responding. You may use an authorized agent to submit a request on your behalf where permitted by law. If we deny your request, you may appeal by contacting us and stating that you are appealing our decision. If you are in the EEA, UK, or Switzerland, you also have the right to lodge a complaint with your local data protection authority.

Notice to California Residents

Under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA), in the preceding 12 months we may have collected the following categories of personal information for the business purposes described in Section 2: identifiers (such as name, email address, phone number, IP address, and device identifiers); commercial information (such as purchase records); internet or other electronic network activity information (such as usage and diagnostic data); and any other information you choose to provide. We disclose these categories only to the recipients described in Section 4. We do not sell or share personal information as those terms are defined under the CCPA, we do not knowingly sell or share the personal information of consumers under 16, and we do not use or disclose sensitive personal information for purposes that would give rise to a right to limit its use.

Residents of other U.S. states with comprehensive privacy laws (including Virginia, Colorado, Connecticut, Utah, Texas, Oregon, and others) may exercise the rights available under their state's law using the same methods.

11. International Data Transfers

Jashan Media LLC is based in the United States, and our service providers may be located in the United States or other countries. If you access the Services from outside the United States, your information may be transferred to, stored in, and processed in countries whose data protection laws may differ from those of your country. Where required, we rely on appropriate safeguards, such as Standard Contractual Clauses, for such transfers.

12. Third-Party Links and Services

The Services may contain links to, or integrations with, third-party websites, apps, and services that we do not own or control. This Privacy Policy does not apply to them, and we are not responsible for their privacy practices. We encourage you to review their privacy policies.

13. Client Projects

When we build websites or apps for clients, the client is typically responsible for the privacy practices of its own product, and we process any end-user data in that product only on the client's behalf and under our agreement with the client. Questions about a client's product should be directed to that client.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date above, and if the changes are material, we will provide additional notice, such as a notice within the Apps or on our website. Your continued use of the Services after an update takes effect means you accept the revised Privacy Policy.

These Terms of Use ("Terms") are a legal agreement between you and Jashan Media LLC ("Jashan Media," "we," "us," or "our") governing your access to and use of our websites, iOS and other mobile applications ("Apps"), and any other products or services that link to these Terms (collectively, the "Services"). Please read them carefully.

1. Acceptance of Terms

By accessing, downloading, installing, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services. Some Services may be subject to additional terms presented to you at the time of use; those additional terms are incorporated into these Terms and control in the event of a conflict for that Service.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Services. If you are under the age of majority where you live, you may use the Services only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf. Certain Apps may have a higher age rating as indicated on the App Store.

3. Accounts

If a Service requires an account, you agree to provide accurate information, keep it up to date, and keep your credentials confidential. You are responsible for all activity under your account. Notify us promptly of any unauthorized use. You may delete your account at any time as described in our Privacy Policy.

4. License to Use the Services

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services, and to download and use the Apps on devices you own or control, solely for your personal, non-commercial purposes (unless otherwise agreed in writing). For Apps obtained from the Apple App Store, this license is also subject to the Usage Rules in the Apple Media Services Terms and Conditions. All rights not expressly granted are reserved by Jashan Media and its licensors.

5. Purchases, Subscriptions, and Refunds

In-app purchases: Paid Apps, in-app purchases, and subscriptions obtained through the App Store are sold and billed by Apple, and are subject to Apple's terms and pricing in your region.
Auto-renewing subscriptions: Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel subscriptions in your Apple ID account settings. Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.
Refunds: Refund requests for App Store purchases are handled by Apple under its policies; we cannot issue refunds for App Store transactions directly. You may request a refund at reportaproblem.apple.com.
Price and feature changes: We may change prices, features, or the content of paid offerings, subject to applicable law and platform rules. Price changes to existing subscriptions will be communicated as required by Apple.
Client services: Development, design, and consulting services we provide to clients are governed by the separate written agreement or proposal between us and the client, which controls over these Terms for those services.

6. User Content

You retain ownership of any content you create, upload, or submit through the Services ("User Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and display your User Content solely as necessary to operate and provide the Services to you. You represent that you have all rights necessary to submit your User Content and that it does not violate these Terms or any law. We may remove User Content that we reasonably believe violates these Terms.

7. Acceptable Use

You agree not to:

Use the Services in violation of any applicable law or regulation, or for any fraudulent, harmful, or unlawful purpose.
Copy, modify, distribute, sell, rent, lease, sublicense, or create derivative works of the Services, except as expressly permitted.
Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Services, except to the extent such restriction is prohibited by law.
Circumvent, disable, or interfere with security features, access controls, or usage limits, including attempting to obtain paid features without paying.
Upload or transmit viruses, malware, or other harmful code, or interfere with or disrupt the Services or their servers or networks.
Use bots, scrapers, or other automated means to access the Services without our written permission.
Harass, abuse, threaten, or infringe the rights (including privacy and intellectual property rights) of others.
Impersonate any person or entity or misrepresent your affiliation with any person or entity.

8. Intellectual Property

The Services, including all software, code, designs, text, graphics, logos, icons, images, audio, video, and other content, and all related intellectual property rights, are owned by Jashan Media LLC or its licensors and are protected by copyright, trademark, and other laws. "Jashan Media" and our logos and app names are our trademarks; you may not use them without our prior written permission. Other trademarks appearing in the Services belong to their respective owners.

9. Feedback

If you send us ideas, suggestions, or other feedback, you grant us the right to use it for any purpose without restriction or compensation to you.

10. Third-Party Services

The Services may include or link to third-party content, services, or integrations. We do not control and are not responsible for third-party services, and your use of them is governed by their own terms and policies.

11. Changes, Availability, and Updates

We may modify, suspend, or discontinue any part of the Services at any time, with or without notice. We may release updates that are required for continued use of an App. We do not guarantee that the Services will be available at all times, compatible with every device, or free from errors.

12. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services are provided "as is" and "as available," with all faults and without warranty of any kind. Jashan Media expressly disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and quiet enjoyment. We do not warrant that the Services will meet your requirements, be uninterrupted, secure, or error-free, or that defects will be corrected.

Information provided through the Services is for general informational purposes only and is not professional (including medical, legal, or financial) advice. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

13. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will Jashan Media LLC, its members, managers, employees, contractors, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or use, arising out of or related to your use of or inability to use the Services, however caused and under any theory of liability, even if advised of the possibility of such damages. Our total aggregate liability for all claims relating to the Services will not exceed the greater of (a) the amount you paid us for the Service giving rise to the claim during the twelve (12) months before the claim arose, or (b) fifty U.S. dollars (US $50).

Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so some of the above limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

14. Indemnification

To the extent permitted by law, you agree to indemnify, defend, and hold harmless Jashan Media LLC and its members, managers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms or any law or third-party right.

15. Termination

You may stop using the Services at any time, including by deleting the Apps from your devices. We may suspend or terminate your access to the Services at any time if you violate these Terms or if required by law. Upon termination, the licenses granted to you end, and you must stop using the Services. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

16. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania and applicable U.S. federal law, without regard to conflict of law principles. Before filing a claim, you agree to contact us and attempt to resolve the dispute informally for at least thirty (30) days. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Pennsylvania, and you and we consent to the personal jurisdiction of those courts. Either party may bring an individual claim in small claims court where eligible. If you are a consumer residing in the EEA, the UK, or another jurisdiction whose laws give you the right to bring proceedings in your home courts or to benefit from mandatory local consumer protections, nothing in these Terms takes away those rights.

17. Export Compliance

You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. government list of prohibited or restricted parties. You agree to comply with all applicable export control and sanctions laws.

18. Changes to These Terms

We may revise these Terms from time to time. We will update the "Last Updated" date above and, for material changes, provide reasonable notice, such as within the Apps or on our website. Changes take effect when posted unless otherwise stated. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

19. General

These Terms, together with our Privacy Policy and any additional terms for specific Services, are the entire agreement between you and us regarding the Services. If any provision is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Headings are for convenience only.

Additional Terms for Apple App Store Apps

The following terms apply to any App you obtain from the Apple App Store ("iOS App"), in addition to the Terms of Use above. If there is a conflict, these terms control for the iOS App.

Acknowledgement: These Terms are concluded between you and Jashan Media LLC only, and not with Apple Inc. ("Apple"). Jashan Media, not Apple, is solely responsible for the iOS App and its content.
Scope of license: The license granted to you for the iOS App is limited to a non-transferable license to use the iOS App on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the iOS App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
Maintenance and support: Jashan Media is solely responsible for providing any maintenance and support services for the iOS App, as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the iOS App.
Warranty: Jashan Media is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the iOS App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the iOS App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the iOS App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Jashan Media's sole responsibility, to the extent not disclaimed.
Product claims: Jashan Media, not Apple, is responsible for addressing any claims by you or any third party relating to the iOS App or your possession and/or use of it, including: (i) product liability claims; (ii) any claim that the iOS App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the iOS App's use of the HealthKit and HomeKit frameworks.
Intellectual property rights: In the event of any third-party claim that the iOS App or your possession and use of it infringes that third party's intellectual property rights, Jashan Media, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
Legal compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
Developer name and contact: Questions, complaints, or claims regarding the iOS App should be directed to Jashan Media LLC using the information in the Contact Us section below.
Third-party terms of agreement: You must comply with applicable third-party terms of agreement when using the iOS App (for example, your wireless data service agreement).
Third-party beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
